Terms of Service
Last updated: 2 October 2026
These Terms of Service ("Terms") govern your access to and use of Kindlyvote ("Kindlyvote", "we", "us" or "our"), the online voting platform at kindlyvote.com and its subdomains and apps. By creating an account, running an event, or casting a vote, you agree to these Terms. If you do not agree, please do not use the service.
1. What Kindlyvote is
Kindlyvote is an online voting platform. Organizers create events, add contestants or options, share voting links, and collect free or paid votes; voters cast votes from any device. Typical use cases include:
- pageants and beauty contests;
- awards and reader's/people's choice voting;
- talent shows and competitions;
- student and association elections;
- fan, music and community voting;
- simple polls and surveys.
2. Definitions
- Organizer — a registered user who creates and manages events and, where enabled, receives payouts from paid votes.
- Voter — any person who casts a vote, free or paid.
- Event — a voting campaign created on Kindlyvote.
- Paid Vote — a vote purchased by a Voter through a supported payment provider.
- Plan — the Free, Pro or Custom tier an Organizer's organization is on.
3. Accounts and eligibility
You must be at least 18 (or the age of majority where you live) to create an account. You are responsible for your account information, for keeping your login secure, and for all activity under your account. Tell us promptly of any unauthorized use.
4. Plans — what to expect on Free vs Pro
Kindlyvote is commission-first: you can run unlimited events for free and only pay a small commission when voters pay for votes. Free voting is always free. The current prices and the full feature list are on the Pricing page; the summary below explains what each plan includes.
Free plan (₦0)
- Unlimited events and contestants/options.
- Free voting — always free, everywhere it's available.
- Paid voting where supported, with a 7% platform commission on paid-vote revenue.
- A branded subdomain (your-org.kindlyvote.com) and basic analytics.
- "Powered by Kindlyvote" branding on your event pages, and third-party ads may be shown on your public event pages (see section 9).
- AI features are not included on Free.
Pro plan (paid subscription)
- Everything in Free, plus:
- A reduced 4% commission on paid votes (down from 7%).
- AI Studio — build events with AI.
- Removal of Kindlyvote branding and ads from your event pages.
- Full analytics with CSV export, and priority support.
- Billed monthly (or yearly) at the price shown at purchase and on the Pricing page, in your market's currency, until cancelled. You can cancel anytime; see section 8.
Custom / Enterprise
For universities, large pageants and high-volume organizers — a done-for-you setup, dedicated support and the lowest commission. Talk to us for a quote.
We may change plan features and prices from time to time; changes take effect going forward and will be reflected on the Pricing page. Your usage is never capped by plan — plans differ in fees, AI, branding, ads and support, not in how many events or voters you can have.
5. Free voting and paid voting
Free voting is available broadly. Where an Organizer enables paid voting, Voters may purchase votes at the price the Organizer sets; those votes are delivered to the event immediately on successful payment. Payments are handled by third-party, PCI DSS-compliant providers (such as Paystack and Flutterwave) — Kindlyvote does not collect or store your full card details. Paid voting and payouts are offered only in supported countries and are subject to verification and applicable law.
6. Fees and commission
- Commission on paid votes is 7% on Free and 4% on Pro of each paid-vote transaction. Free voting carries no commission.
- Pro subscription is billed recurringly at the price shown at purchase until cancelled.
- Taxes applicable to your use of the service or to amounts you collect are your responsibility.
7. Payouts
Where paid voting is supported, Organizers may withdraw their net earnings (paid-vote revenue less commission and fees), subject to identity verification (KYC), a valid payout account, and our review. In some markets payouts are processed manually. We may hold, delay or reverse payouts where we reasonably suspect fraud or chargebacks, where an event breaches these Terms, or where required by law or our payment partners.
8. Refunds and cancellation
- Paid votes are digital items delivered instantly and are generally non-refundable, except for a duplicate/erroneous charge, a technical failure where votes weren't delivered, or a payment confirmed to be fraudulent. Contact support@kindlyvote.com within 14 days to request a review.
- Pro subscription can be cancelled anytime; your Pro features remain until the end of the current paid period. Fees already paid for the current period are non-refundable except where required by law.
9. Advertising on Free-plan pages
To keep the Free plan free, Kindlyvote may display third-party advertisements on the public event pages of Free-plan organizers. Pro-plan organizers' pages are ad-free. Ads are served by third-party networks; we don't control every advertiser and are not responsible for the content of third-party ads, though we aim to keep them clean and relevant and will act on reports of inappropriate ads. Upgrading to Pro removes ads.
10. Acceptable use
You and your events must:
- comply with all applicable laws, including those on contests and promotions;
- only use content you own or have permission to use, without infringing anyone's rights;
- not be fraudulent, misleading, defamatory, obscene, hateful or otherwise unlawful;
- not manipulate results, create fake or automated votes, or misrepresent how votes are counted;
- not abuse, spam or defraud voters, launder funds, or harm Kindlyvote or its payment partners.
Organizers are solely responsible for their event's conduct, rules, prizes and outcome.
11. Content and intellectual property
The Kindlyvote platform, software, branding and design are owned by Kindlyvote. You keep ownership of the content you upload (such as contestant names and images); by uploading it you grant us a non-exclusive, worldwide licence to host and display it solely to run your event and the service.
12. Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
13. Suspension and termination
We may suspend or terminate an account or event that breaches these Terms, where required by law or our payment partners, or to protect voters and the integrity of the platform. You may stop using the service at any time. Fees owed, intellectual-property, disclaimer and liability provisions survive termination.
14. Disclaimers
The service is provided "as is" and "as available", to the fullest extent permitted by law. We don't guarantee the service will be uninterrupted or error-free, or that any event will reach a particular outcome. Kindlyvote is not the organizer of any event and is not responsible for prizes, promises or disputes between Organizers and Voters.
15. Limitation of liability
To the fullest extent permitted by law, Kindlyvote is not liable for indirect, incidental, special or consequential damages, or loss of profits, data or goodwill. Our total liability relating to the service will not exceed the fees you paid us in the three (3) months before the claim, or the minimum required by law.
16. Changes to these Terms
We may update these Terms from time to time. Material changes are reflected by updating the "Last updated" date above; continued use after changes take effect means you accept them.
17. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria, subject to the exclusive jurisdiction of the courts of Nigeria, without prejudice to any mandatory consumer protections available to you.
